Many homes in Las Vegas and Henderson are in a Common Interest Community (CIC) and have CC&R's.  CC&R's are Covenants, Conditions and Restrictions on the property.  According to NRS 116.1409, a seller must provide a potential buyer with the Homeowner's Association (HOA) documents including these CC&R's.  It is important that a buyer reads these documents thoroughly, especially if the buyer intends to make any improvements to the property after closing.  Why? Because some CC&R's prohibit certain types of improvements.

When I purchased my home, I knew that I wanted to put new solar screens on all the windows and back sliding glass door.  I also knew that I was going to completely redo the front yard.  I reveiwed the CC&R's and found that there were only certain types of plants that I could put in the front yard and there had to be a tree as well...this helped in planning the renovation.  As for the solar screens, only a few colors were allowed.  And, all changes to the exterior of my home had to be passed by the HOA's Architectural Committee. Prior to submitting those renovation plans to this committee, however, I needed to get signatures from my neighbors...the two on either side of me, the one in front of me and the one behind me.  It was time consuming to get the neighbor's signatures but again, knowing what the requirements were up front helped make those renovations easy.

So, if you intend to make changes to the exterior of your property (front or back), make sure you read the CC&R's.
